User Agreement

This User Agreement (“Agreement“) governs your use of the Playmanity website, services, and mobile applications (collectively, the “Platform“). By accessing or using our Platform, you agree to be bound by this Agreement. If you do not agree to the terms of this Agreement, you may not use our Platform.

1.1. Account Creation

To use certain features of our Platform, you may be required to create an account. You agree to provide accurate and complete information during the registration process.

1.2. Account Security

You are responsible for maintaining the confidentiality of your account login information and are fully responsible for all activities that occur under your account.

1.3. Age Requirement

You must be at least 13 years old to use our Platform. If you are under 18, you may use our Platform only with the involvement of a parent or guardian.

Intellectual Property

2.1. Content Ownership

All content on our Platform, including text, graphics, logos, and images, is the property of Playmanity or its licensors and is protected by intellectual property laws.

2.2. License

By using our Platform, you are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the content for personal, non-commercial purposes.

User Conduct

3.1. Prohibited Activities

You agree not to engage in any of the following activities while using our Platform:
Violating any laws or regulations
Impersonating any person or entity
Interfering with the operation of our Platform
Uploading, transmitting, or distributing any harmful, defamatory, or obscene content

3.2. Content Submission

If you submit any content to our Platform, excluding games and game studios, you grant Playmanity a worldwide, royalty-free, and perpetual license to use, reproduce, modify, adapt, publish, and distribute the content.

Termination

4.1. Termination by You

You may terminate this Agreement at any time by ceasing to use our Platform.

4.2. Termination by Playmanity

Playmanity may terminate this Agreement and suspend or terminate your account for any reason, including violation of this Agreement.

5. Disclaimer of Warranties

Our Platform is provided on an “as-is“ and “as-available“ basis, without any warranties or representations. We do not guarantee that our Platform will be uninterrupted or error-free.</p>

6. Limitation of Liability

Shall Playmanity not be liable for any indirect, consequential, or incidental damages arising out of or related to your use of our Platform.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Ukraine.

8. Changes to this Agreement

We may update this Agreement occasionally to reflect changes in our practices or for other operational, legal, or regulatory reasons. The updated version will be posted on our Platform with the effective date..

Playmanity Developer Agreement

This Developer/Pusblisher Agreement ("Agreement") is entered into by and between [Developer’s/Pusblisher’s Name or Organization] ("Developer/Pubslisher) and Playmanity, a gaming platform ("Playmanity").

10.1. Developer/Pusblisher Status and Use of Materials:

By using the Playmanity platform and adding their organization (studio) and game/s to the site, the Developer/Publisher is officially considered a game developer/publiser affiliated with Playmanity. The Developer/Publisher grants Playmanity the right to use the game, photos, and videos from the game for promotional purposes on the Playmanity platform.

10.2. Revenue Sharing:

If the Developer/Publisher adds a game to the platform, they agree that 80% of the revenue generated goes to them, and Playmanity retains 20%.

10.3. Game Pricing:

The Developer/Publisher agrees that if the price tag for the game is equal to or greater than 0,99 on the site, it is the legal price, and the game is not entirely free on the platform, as advertisements are displayed.

By using the Playmanity platform and adding content, the Developer acknowledges and agrees to the terms outlined in this Agreement.

This Agreement is effective as of 2.12.2023.
